FDA filed its responses claiming that only some clarifications to FDA’s 2009 Final Rule are warranted, and that amalgam will continue to be classified in Class II. Attorney James M. Love, who filed the lawsuit, stated that, “the FDA continues to allow the American people to be poisoned by their mercury fillings despite the scientifically demonstrated risks. Read more
The U.S. Food and Drug Administration (FDA) has updated its consumer advisory on dental amalgam, but it has not changed its position on dental amalgam fillings. "The FDA has reviewed the best available scientific evidence to determine whether the low levels of mercury vapor associated with dental amalgam fillings are a cause for concern. Based on this evidence, FDA considers dental amalgam fillings safe for adults and children ages 6 and above," states the advisory, updated on January 27. Read more
In October of 2014, a personal dental malpractice lawsuit was quietly settled out of court in favor of plaintiff, Freya Koss, who alleged that her dentist had exposed her to dangerous levels of mercury vapor during the unsafe removal of an existing amalgam filling and replacement of a new one.
